1. Who you are contracting with

Business Genie AI is a service operated by Pitch Check AI ("we", "us", "our"), the legal seller of record for all purchases. These Terms & Conditions form the agreement between you and Pitch Check AI for your use of the Business Genie AI website and service (the "Service"). If you do not agree to these terms, do not use the Service.

2. Acceptance and eligibility

By creating an account, purchasing credits, or continuing to use the Service, you agree to these terms. You confirm that you are of legal age to enter a contract in your country, and that if you are using the Service on behalf of a company or other organisation, you have the authority to bind that organisation to these terms.

3. What the Service does

You submit a written pitch, and optionally an image such as a slide or screenshot. The Service uses third-party generative AI models to return a critique: scores, a verdict, criticisms, suggested fixes, and a rewritten version of your pitch. You can choose the professional lens (for example CEO, CFO, or Venture Capitalist) the critique is written from. Each completed critique consumes one credit from your account balance.

4. Accounts and credits

  • You must provide accurate registration information and keep it up to date.
  • You are responsible for keeping your password confidential and for all activity that happens under your account.
  • Credits are a prepaid allowance to use the Service. They are not money, carry no cash value, and cannot be transferred, resold, or exchanged between accounts.
  • New accounts may receive a limited number of free credits at our discretion. Free credits may be withdrawn or changed at any time.
  • If a purchase is refunded or reversed, we may remove the corresponding credits from your balance.
  • Purchased credits do not expire while your account remains open.
  • If a critique fails for technical reasons, the credit is automatically returned to your balance.

5. Acceptable use

You must not use the Service to:

  • break any law, or infringe anyone's intellectual property, privacy, or other rights;
  • commit fraud, send spam, or misrepresent who you are;
  • submit or generate unlawful content, hate speech, harassment, sexual content involving minors, malware, or deceptive material such as deepfakes intended to impersonate a real person;
  • attempt to jailbreak, prompt-inject, or otherwise circumvent the safety controls or usage limits of the Service or the AI models it relies on;
  • interfere with the security or integrity of the Service, including probing, scanning, scraping, automated bulk access, or reverse engineering;
  • resell, redistribute, or provide the Service to third parties as your own product.

6. AI content: your responsibilities and ours

  • You are responsible for what you submit. You confirm you have the rights to any pitch text or image you upload, and that submitting it does not breach anyone's confidentiality or intellectual property.
  • You are responsible for how you use the output. Critiques are opinionated automated feedback, not professional, legal, financial, or investment advice, and are not a prediction of whether you will raise money or succeed.
  • Output may be inaccurate. Generative AI can be wrong, biased, or misleading, and can produce similar output for different users. Verify anything important before relying on it.
  • You keep ownership of the pitch content you submit. You grant us a limited licence to host and process it in order to provide the Service to you. Subject to these terms, you may use the critique output we return to you for any lawful purpose.
  • We may moderate content. We may filter, refuse, restrict, or remove submissions or outputs, and may suspend accounts where we reasonably believe this section has been breached.

If you believe content on the Service infringes your intellectual property or other rights, contact us using the details in section 13 with enough information to identify the content and your rights in it. We will review the report and remove infringing content where appropriate. Accounts that repeatedly or seriously infringe the rights of others will be terminated.

7. Our intellectual property

We own the Service and everything in it other than your submitted content, including the software, prompts, scoring methodology, interface, documentation, and branding. We grant you a limited, non-exclusive, non-transferable right to use the Service in line with these terms and the credits you hold. No other rights are granted.

8. Payment, billing, and taxes

Credits are sold as one-time purchases at the prices shown at checkout. There is no subscription and nothing renews automatically, so there is no recurring charge to cancel.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment, billing, invoicing, applicable taxes, and refund mechanics are therefore governed by Paddle's Checkout Buyer Terms. Our own refund commitment is set out in our Refund Policy.

9. Availability and warranties

We aim to keep the Service available and useful, but we do not guarantee that it will be uninterrupted, timely, secure, or error-free, and we may change or discontinue features. The Service depends on third-party AI providers whose availability we do not control. To the fullest extent permitted by law, we exclude all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

10. Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, or consequential loss, including lost profits, lost revenue, lost funding, lost data, or damage to goodwill. Our total aggregate liability arising out of or in connection with the Service is limited to the amount you paid us in the twelve months before the claim arose. Nothing in these terms limits liability for fraud, death, or personal injury caused by negligence, or any other liability that cannot be limited by law.

You agree to indemnify us against claims, losses, and reasonable costs arising from content you submit, your unlawful use of the Service, or your breach of these terms.

11. Suspension and termination

We may suspend or terminate your access, with notice where practical, if you materially breach these terms, fail to pay, create a security or fraud risk, or repeatedly or seriously breach our acceptable use rules. You may stop using the Service and close your account at any time. When your account ends, your saved critique history and account data are deleted or anonymised as described in our Privacy Notice. Unused credits are not refundable on termination for breach; otherwise our Refund Policy applies.

12. Changes, law, and general terms

  • We may update these terms; material changes will be reflected in the 'last updated' date above, and continued use after that date means you accept the updated terms.
  • You may not assign these terms without our consent. We may assign them as part of a merger, acquisition, or sale of assets.
  • Neither party is liable for delays caused by events beyond its reasonable control.
  • If any provision is found unenforceable, the rest of these terms remain in effect.
  • These terms are governed by the laws of the jurisdiction in which Business Genie AI is established, and the courts of that jurisdiction have exclusive jurisdiction over disputes.
